Abstract
This paper analyzes the transitional justice instruments derived from the legal framework for peace in Colombia, especially, the mechanism for total sentence execution suspension, which constitutes an international wrongful act. To this end, an approximation to the international responsibility of the State under human rights International Law is carried out with emphasis on amnesties, pardons or legal concepts that establish impunity systems prohibition. Finally, it establishes the role of the victim against the State and the illegality consequences from the International Law perspective.
