Abstract

This contribution seeks to provide a non-conventional answer to the question posed by the legal value of the Universal Declaration of Human Rights, in view of the fact that, without having the binding character of a treaty, its provisions have been cited or have been expressly included in multiple constitutions and laws, and its principles have served as a basis for human rights covenants, conventions and treaties, so that, although it would seem to be no more than a soft law instrument, its content has served as a reference for the adoption of various conventional human rights instruments, even if many States do not respect international obligations in this area.
