Abstract

Internationalization of administrative law or global administrative law? This epistemological debate in comparative public law is currently defining the instruments through which national, regional, and global legal-administrative orders interact. How can a world connected by conflicting economic, computer, and legal networks be better governed by law? There is no single answer. There exist two opposing poles. The first is global administrative law, of Anglo-American inspiration, in which the international legal order is based on international standards and organizations and where the “universality” of the administrative and legal culture of the United States is imposed. An exercise of global legal hegemony? The second is the European Union (EU), that of the internationalization of administrative law, which, using national legal traditions (French, German, Italian, and Spanish), proposes to build a top-down regional legal order on common legal values to scale an orderly legal pluralism in a world of multiple facets. This book presents the debate that took place in 2018 at the Université Paris II Panthéon-Assas among the most renowned professors of these two doctrines. And this Spanish translation proposes to open such a debate in Latin America. What is our role? Can we propose a third way?
