Abstract
The previous consultation, which is a fundamental right, has been considered as a valuable instrument which promotes the respect for the rights of indigenous peoples, specially of those rights related with the territory, the identity, the autonomy and the participation, among others. In the last years the previous consultation has been repeatedly violated. It must be exerted every time an administrative or legislative decision that may affect directly these peoples must be taken. The present document expects to take a look at the main statements pronounced by the Constitutio-nal Court regarding the previous consultation related to legislative measures.
