Abstract

The purpose of this article is to identify the specific features of International Criminal Law and Transnational Criminal Law. In particular, the purposes and foundations of each system will be analysed in order to evaluate whether the scope of application of International Criminal Law could be extended to transnational crimes. On this regard, there will be a close evaluation of cases in which an analysis of the possible characterization of such conduct as crimes against humanity is imperative because of their nature, intensity, scale and systematicity of the violence.
