Aquellos límites han sido impuestos de forma progresiva en la historia del derecho estadounidense, buscando frenar la afluencia de decisiones con condenas in-mensas por concepto de daños punitivos, que durante su proceso de adjudicación involucran el controversial papel del jurado en la justicia civil estadounidense y que, en general, han sido concedidos en procesos de responsabilidad extracontrac-tual bastante notorios, como en el famoso caso Stella Liebeck vs. McDonald’s Restaurants, P.T.S., Inc. and McDonald’s International, Inc., también conocido como el “caso del café caliente”63.

En su análisis del caso, la Suprema Corte consideró que aunque los daños pu-nitivos seguían siendo utilizados por las Cortes de los Estados para proteger a sus ciudadanos de prácticas indeseadas, los rubros otorgados no podían constituir una violación abierta al debido proceso, al no tener una base legal y rebasar ampliamente cualquier proporcionalidad.

La disparidad efectiva entre el monto otorgado por daños punitivos y el monto otorgado por daños compensatorios: si bien la Suprema Corte reconoce la libertad de cada jurisdicción estatal para establecer las proporciones que deben conservarse en las sentencias entre estos dos rubros, este criterio se convierte ahora en un control a favor del debido proceso y en sentencias posteriores de la Suprema Corte, que han desarrollado el contenido del “test de Gore”, como la sentencia State Farm Mutual Automobile Ins. Co. vs. Campbell, y se han planteado de forma sugerente posibles máximos a esta relación (4 a 1 frente a los compensatorios)79.

N2 - This article pretends to give account of the recent evolution in the application of the figure both in countries of the continental law, in which a tendency can be identified in favor of incorporating this way of appreciating the damages in areas like the protection of consumers, environment or Human Rights, and in the other hand, the tendency in the common law of the United States to establish limits to this sanctions, considering them in many cases excessive and disproportionate.
