Abstract
This compilation consists of sixteen chapters that present reflections, debates, and solutions proposed by each author using a qualitative research methodology with a dogmatic approach. Important cultural, historical, and practical issues have been addressed applying logical thinking, analysis, and a thorough understanding of concepts, based on the most important doctrinal, normative, and jurisprudential sources for each topic. In some cases, a comparative analysis of law was undertaken, which allows understanding even better the advantages or shortcomings of the law studied. The underlying methods correspond to the logical, systematic, ideological, and empirical analysis of each author, and they are the result of the authors’ experience in litigation, work in the High Courts, in the academy, or in the private sector, and, in general, their knowledge of the Colombian reality.
